1. TERMS AND CONDITIONS
   Welcome to www.JordanCrafts.com/JordanCrafts.com (hereinafter known as the “Site”). This Site is maintained and operated by Creations hereinafter known as (“Creations” or “Company”).
   By accessing, browsing or using this Site, you explicitly acknowledge that you have read, understood and irrevocably agreed to be bound by these Terms of Use (hereinafter known as the “Terms”). If you do not agree to these Terms, you should not use or access this Site nor contact the site owners/operators. Creations reserves the right to revise these Terms at any time by updating this posting. You are encouraged to review these Terms each time you use the Site. By agreeing to these Terms it also constitutes your agreement to the Site Privacy Policy, which is incorporated herein.
   BY ACCESSING OR USING ANY PART OF THE SITE, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THE TERMS SET FORTH BELOW, YOU MAY NOT USE ANY PORTION OF THE SITE. PRICE INFORMATION FOUND ON THIS SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. CREATIONS RESERVES THE RIGHT TO CHANGE THESE TERMS & CONDITIONS OF USE AT ANY TIME WITHOUT NOTICE.
   We grant you a personal, limited, non-transferable non-exclusive, license to access and use the Site. We reserve the right, in our sole discretion and without notice to you, to revise the products and services available on the Site and to change, suspend or discontinue any aspect of the Site and we will not be liable to you or to any third party for doing so. We may also impose rules for and limits on use of the Site or restrict your access to part, or all, of the Site without notice or penalty. Your continued use of the Site will constitute your acceptance of any such changes.

2. Use of the Site
   You may use the Site only for your own noncommercial personal use and in compliance with these Terms. You are responsible for your own communications, including the transmission, uploading or posting of information and are responsible for the consequences of such communications to the Site. Any other use of the Site requires the prior written consent of Creations. You may not otherwise copy, modify, or distribute the contents of this Site without the express written permission of Creations. You may not modify, publish, transmit, participate in the transfer or sell, create derivative works from, or in any way exploit, any of the content, in whole or in part, found on the Site.
   You may not use spiders, robots, data mining techniques or other automated devices or programs to catalog, download or otherwise reproduce, store or distribute content available on the Site. Further, you may not use any such automated means to manipulate the Site, such as automating what are otherwise manual or one-off procedures. You may not take any action to interfere with, or disrupt, the Site or any other user’s use of the Site, including, without limitation, via means of overloading, “flooding”, “mailbombing” or “crashing” the Site, circumventing security or user authentication measures or attempting to exceed the limited authorization and access granted to you under these Terms. You may not frame portions of the Site within another web site. You may not resell use of, or access to, the Site to any third party without our prior written consent.

3. Registration and Passwords
   In order to access certain services on the Site, you will be required to provide specific information. All information about you must be truthful, and you may not use any aliases or other means to mask your true identity. Any access codes or passwords provided should be safeguarded at all times. You are responsible for the security of your access codes and passwords and will be solely liable for any use or unauthorized use under such access codes or passwords. 4. Additional Terms and Conditions
   You agree that additional terms and conditions may apply to specific products, orders or your use of certain portions of the Site, including with respect to ordering, shipping and return policies and review guidelines, which Additional Terms are made part of these Terms by reference. If there is a conflict between these Terms and the Additional Terms, the Additional Terms shall control.

5. Product variations & Limitation on Quantities
   Such is the nature of hand-made products that a certain amount of variations and ‘imperfections’ occur in every product. Such imperfections or inconsistencies could be due to variations in natural stone colors, and weights of mosaics. While every effort is done on the producer’s side to reproduce items to his/her best possible capacity similar to that shown on the product page, yet, by using this site and/or placing an order YOU EXPLICITLY ACKNOWLEDGE YOUR ACCEPTANCE OF THESE VARIATIONS IN PRODUCT SIZE OR WEIGHT OR COLOR VARIATIONS OR MATERIALS. SUCH VARIATIONS DO NOT CONSTITUTE A BREACH OF CONTRACT FROM OUR SIDE AND DO NOT CONSTITUTE GROUNDS FOR A CLAIM OF RETURN OR REFUND ON YOUR PART.
   JordanCrafts.com is also a marketplace, open for third parties and producers to post their products for sale. We strive to ensure that the information on the Site is complete and reliable to the best of our abilities. As such, JordanCrafts.com is not liable for any content which submitted by Site users or third parties that may contain errors or inaccurate product images or information. By using this site, you agree to buy these products “as is” waiving any rights to claim any damages arising from using or purchasing these products from us or third parties. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies which we may correct without liability. We also reserve the right to limit quantities purchased by users and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted and/or acknowledged). Some of the items shown on the site are made to order, and may be out of stock. Such items will be ordered from our suppliers and may be shipped at a later date than normal. We will do our utmost to notify you of the expected shipping date in case an item is out of stock, or in case the item is no longer available. We do not guarantee that all products described on our Site will be available or in stock.

6. Proprietary Rights
   You acknowledge and agree that the content (other than content that may be submitted by users), materials, text, images, videos, graphics, trademarks, logos, button icons, music, software and other elements available on the Site are the property of Creations or our licensors and are protected by copyright, trademark and/or other proprietary rights and laws. You agree not to sell, license, rent, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, modify or create derivative works from any content or materials on the Site. Creations® and the JordanCrafts.com logo are registered trademarks of Masannat Design Establishment. All other trademarks are the property of their respective owners. All of our Site’s content is Copyright 2024 Creations®. All rights reserved. Except as expressly set forth in these Terms, no license is granted to you and no rights are conveyed by virtue of accessing or using the Site. All rights not granted under these Terms are reserved by Creations.

7. Submitted Content
   By submitting or posting any materials or content on the Site, you grant Creations a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such materials. You hereby represent, warrant and covenant that any materials you provide do not include anything (including, but not limited to, text, images, music or video) to which you do not have the full right to grant Creations the license specified above. You further represent, warrant and covenant that any materials you provide will not contain libelous or otherwise unlawful, abusive or obscene material. Creations will be entitled to use any content submitted by you without incurring obligations of confidentiality, attribution or compensation to you.

8. Disclaimers
   You assume all responsibility and risk with respect to your use of the Site. THE SITE, AND ALL CONTENT, MERCHANDISE, AND OTHER INFORMATION ON OR ACCESSIBLE FROM OR THROUGH THIS SITE OR A “LINKED” SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY OR ACCURACY. Creations makes no warranties of any kind regarding any non-Creations sites to which you may be directed or hyperlinked from this Site. Hyperlinks are included solely for your convenience, and Creations makes no representations or warranties with regard to the accuracy, availability, suitability or safety of information provided in such non-Creations sites. Creations does not endorse, warrant or guarantee any products or services offered or provided by or on behalf of third parties on the Site.

9. Taxes and Import Duties
   Your total price will include the price of the product only. Shipping cost will cover shipping to your specified destination. We may use a variety of shipping services to get your order to your doorstep in the best possible way and not necessarily use the shipper(s) mentioned in your order basket.
   YOUR ORDER DOES NOT INCLUDE ANY CUSTOMS FEES AT THE COUNTRY OF DESTINATION. IT IS THE SOLE RESPONSIBILITY OF THE BUYER TO CLEAR HIS/HER ORDER THROUGH CUSTOMS, SATISFY IMPORT REQUIREMENTS AND PAY ANY RESULTING DUTIES OR OFFICIAL FEES OF ANY KIND, IF ANY, AS A RESULT OF HIS/HER ORDER. Creations will not be responsible for any levies, duties or additional costs arising from import regulations/processes. If the buyer does not comply or is not able to satisfy customs and or import regulations at the country of destination and the shipment ends up being sent back to origin, Creations will not reimburse the buyer for any shipping; packaging and handling costs. IF AN ORDER IS SENT BACK TO ORIGIN for any reason the following rules apply:
   1. a) normal items with a regular shipping fee will be refunded LESS a 30% restocking fee only if items are in mint, sealed and un-opened condition. SHIPPING CHARGES WILL NOT BE REFUNDED. b) Items shipped under the “Free Shipping” promotion will be refunded LESS 50% restocking fee only if items are in mint, sealed and un-opened condition.

10. Indemnification
    You agree to indemnify, hold harmless, and defend Creations®, Creations.jo, JordanCrafts.com, Masannat Design Establishment and their owner(s), employees, suppliers, subsidiaries, divisions, and affiliates, and their respective officers, directors, employees, agents and affiliates from any and all claims, liabilities, damages, costs and expenses of defense, including attorneys’ fees, in any way arising from or related to your use of the Site or otherwise arising from the provision of goods and services or from any contravention of any legal requirements or your violation of these Terms or the Privacy Policy, content posted to the Site by you, or your violation of any law or the rights of a third party.

11. Limitation of Liability
    IN NO EVENT SHALL CREATIONS, ITS OWNERS, SUBSIDIARIES, AFFLIATES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, SUBSIDIARIES, SUPPLIERS, AFFILIATES, OR THIRD PARTIES PROVIDING INFORMATION ON THIS SITE BE LIABLE TO ANY USER OF THE SITE OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF USE) ARISING OUT OF THE USE OR INABILITY TO USE THE SITE, WHETHER BASED UPON WARRANTY, CONTRACT, TORT, OR OTHERWISE, EVEN IF CREATIONS HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. IN NO EVENT SHALL THE TOTAL LIABILITY OF CREATIONS , ITS AFFILIATES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, SUBSIDIARIES, SUPPLIERS, AFFILIATES OR THIRD PARTIES PROVIDING INFORMATION ON THIS SITE TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION RESULTING FROM YOUR USE OF THIS SITE, WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE, EXCEED THE AMOUNT YOU PAID TO CREATIONS IN CONNECTION WITH THE EVENT GIVING RISE TO SUCH LIABILITY. You hereby acknowledge that the preceding paragraph shall apply to all content, merchandise and services available through the Site.

12. International Use
    We control and operate the Site from the Hashemite Kingdom of Jordan. The site is hosted outside the Hashemite Kingdom of Jordan. We make no representation that materials on the Site are appropriate or legal for use or import in countries other than the Hashemite Kingdom of Jordan. If you choose to purchase items from this Site from outside the Hashemite Kingdom of Jordan, you do so at your own risk and are responsible for compliance with local import laws, if and to the extent local laws are applicable.

13. Risk of Loss
    Any merchandise purchased from our Site will be shipped by either by JordanCrafts.com or a third party carrier. In either case, title and risk of loss for such merchandise will pass to you upon final delivery of said merchandise.

14. Prevalence of Terms and Conditions Over Subsequent Purchase Orders and Legal Agreements
    Any offers, bids or agreements entered into between Creations and/or JordanCrafts.com and/or Masannat Design Est with a client as a result of a client using this site shall be irrevocably governed by THE TERMS AND CONDITIONS herewith and shall supersede and overrule any legal agreements, conditions or clauses that may be entered into with a client or entity pursuant to placing a purchase order for products and services provided by JordanCrafts.com, Creations or Masannat Design Est. Any clauses or conditions of contract or bids or subcontracts entered into in the past, present and future shall always comply by the TERMS AND CONDITIONS of the Site, and if any conflict or disagreement arises between these agreements, bids, offers, contracts or subcontracts arise, the site user irrevocably agrees that TERMS AND CONDITIONS of the Site shall prevail at all times, regardless of any content in those agreements of communications written or otherwise even if it bears signatures of representatives of JordanCrafts.com and/or Creations and/or Masannat Design Est..

15. Copyright Infringement; Notice and Take Down Procedures
    Creations specifically prohibits the posting of any content that violates or infringes the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity. If you believe that any material contained on this Site infringes your copyright or other intellectual property rights, you should notify us of your copyright infringement claim in accordance with the following procedure. Creations will process notices of alleged infringement which it receives and will take appropriate action as required by the laws of the Hashemite Kingdom of Jordan. 16. Governing Law
    The laws of the Hashemite Kingdom of Jordan shall govern these Terms. YOU HEREBY EXPRESSLY CONSENT TO EXCLUSIVE JURISDICTION AND VENUE IN THE COURTS LOCATED IN THE HASHEMITE KINGDOM OF JORDAN FOR ALL MATTERS ARISING IN CONNECTION WITH THESE TERMS AND CONDITIONS OR YOUR ACCESS OR USE OF THE SITE.

17. ORDERING & SHIPPING
    You will be notified by email upon successful completion of your order. Orders will normally ship between 3-4 days from order date (not counting weekends – Fridays and Saturdays – and/or national holidays). Some items are made in workshops in remote parts of Jordan and take some time to be picked up.
    Most items displayed on the store are in stock. However, some hand crafted items are produced by artisans as a ‘one-of-a-kind’ item. These will be displayed on the store. While we make every effort to track these unique pieces, it is impossible to do so accurately all the time due to the large number of suppliers we have. If you place an order on one of these pieces, we will immediately notify you if the item you requested became unavailable, in which case, you have the option of cancelling your order at no cost, or opting to have an identical piece produced at the same cost of the item purchased and you will be notified of the estimated production and shipping dates.
    JordanCrafts.com ships to all physical addresses globally. We use multiple shipping companies to deliver our products.

18. RETURNS
    18.1 THE FOLLOWING ITEMS CANNOT BE RETURNED AND NO REFUNDS WHATSOEVER WILL BE ISSUED:
    1. ANY TYPE OF COSMETIC OR BEAUTY PRODUCTS, DEAD SEA COSMETICS, OILS, SOAPS OR ANY TYPE OF PERSONAL HYGIENE PRODUCTS.
    2. ANY PERSONALIZED OR ENGRAVED ITEMS OR CERAMICS WITH CUSTOMIZED OR SELECTED NAMES.
    3. ANY CUSTOM MADE ORDERS OR MADE TO ORDER GIFT PACKAGES OR CORPORATE GIFT PACKAGES OR PERSONAL GIFTS OR CURATED GIFT PACKAGES.
    4. MOSAICS, HANDMADE CERAMICS AND ACCESSORIES
    5. ANY TYPE OF FOOD OR EDIBLE PRODUCTS, DELICACIES, NATURAL OILS OR SWEETS
    6. ANY PACKAGES THAT CONTAIN PARTIALLY OR FULLY ANY OF THE ITEMS LISTED IN ITEMS 1 THROUGH 5 ABOVE.

    18.2 FOR ALL OTHER TYPES OF PRODUCTS, THE FOLLOWING POLICY WILL APPLY:
    Your satisfaction is important to us. If for some reason you are unhappy with your product, you may request to return it for store credit within 7 calendar days from receiving the shipment. Please email us your return request at sales@JordanCrafts.com with a little note explaining the reason you were dissatisfied with the product. After receiving a return merchandise authorization (RMA) number from us, we will ask you to ship the product back with the RMA number marked on the outside package. After we receive the product and make sure that it is in its original unused condition we will issue you store credit, which you can use anytime within 12 months from the sale date in our store. We do not however reimburse or credit you for shipping charges. All returned items must be in their original state, without blemishes or scratches or showing signs of wear and tear.
    If a product arrives showing any signs of damage during transit, please take a photo of the product and email us at sales@JordanCrafts.com within 2 calendar days from receiving the product. You will receive a replacement item at no cost to you and will be instructed on what to do with/how to ship back the defective item.
    If you wish to exchange a product, you will need to notify us via email within 3 calendar days of receiving your order. Any exchange requests received after 3 days of delivery of said product(s) will not be honored. Same procedure as returned merchandise above applies.
    Please send us an email to sales@JordanCrafts.com with your order number in the subject title followed by the word “Return”. Please state clearly in the email your reasons for return and whether you’d like a store credit or exchange, and for which product. Exchanges are usually processed and dispatched within a few days of receiving the goods back.
    Please note that we can only exchange an item for the same price or lower price than the original item (if lower, we will credit you for the difference less shipping charges for the original sale and shipping the new product as we currently do not offer a free returns service).

19. GENUINE JORDANIAN PRODUCTS
    By working directly with Jordanian artisans, workshops, companies and manufacturers, we strive to ensure that all our products are genuine Jordanian in nature/origin in line with our mission and vision of supporting the handicrafts sector and related industries.
    We do not deal with cheap foreign imitations or items that are manufactured outside the country to look like Jordanian souvenirs. With the exception of raw materials and raw fabrics, which may be manufactured outside Jordan and used to make Jordanian traditional products or traditional wear.

20. IMPORT DUTIES
    Due to some import/export restrictions in some countries, the description of some item(s) may be abridged or vary slightly on the invoice from that on the website. But you will receive the exact item you order as shown on the website regardless of the item description details in the paperwork attached to your shipment.
    Additionally, JordanCrafts.com sells the products and ships to the destination country of the customer’s choice. It is the responsibility of the buyer to cover any import/customs duties, and deal with import clearance procedures and regulations at his/her destination country. JordanCrafts.com will not be liable to any such duties, fees or additional costs due to the rejection/delay/levies due to the import regulations of his/her destination country. If for any reason the merchandise is undelivered, and/or rejected and returned to origin, we will give back store credit to the customer on returned goods received in good condition less shipping, taxes and costs incurred plus a 15% restocking fee.
